Notice is hereby given pursuant to M.G.L. c. 30A, § 2 that the Massachusetts Bay Transportation Authority (MBTA) will hold a public hearing and accept public comments regarding a proposed new regulation 703 CMR 3.00 Authority Employees Compensated by Someone Other Than the Commonwealth or the Authority.

The proposed regulation will enhance the MBTA's workforce through a secondment program utilizing on a temporary basis Special Authority Employees who are otherwise employed by private businesses and who are compensated by their sending employer(s) while in service to the Authority. The use of Special Authority Employees grants the Authority access to a uniquely qualified workforce not otherwise available to the Authority and enhances the Authority’s ability to perform its powers, obligations and duties as set forth in M.G.L. c. 161A. There is no fiscal impact on cities or towns. The proposed regulation does not impose new costs on small businesses.

The authority for these regulations is M.G.L. c. 161A, § 3(e): ". . . . In addition to the powers granted to the authority by law, the authority shall have the following powers: . . . To make, and from time to time revise and repeal, by-laws, rules, regulations and resolutions."

Testimony may be presented orally at the public hearing or in writing. While MBTA encourages all interested parties to submit testimony in advance of the hearing, written comments will be accepted until 5:00 p.m. on Friday, October 27, 2017.
